Privacy Policy

This policy explains what personal information we collect through Southern Marin Agents, why we collect it, how we use and share it, and the choices and rights you have, including your rights under California law.

01Who we are

Southern Marin Agents (the "Site") is operated by Agent Mojo, LLC ("we," "us," or "our"). The Site is a curated advertising directory that helps people in Marin County, California discover and contact local real estate agents, and it publishes related neighborhood and lifestyle information.

This Privacy Policy applies to information we collect on the Site and through the forms and tools we provide. It does not apply to the independent real estate agents, brokerages, or other third parties you may contact through the Site, they maintain their own privacy practices, and we encourage you to review them.

Plain-language summary

We collect the information you give us through our forms (so we can connect you with agents or process an agent's application or ad), plus basic technical data your browser sends. We do not sell your personal information. You can ask us to access or delete your data at any time.

02Information you provide to us

Most of the information we hold is information you choose to give us when you use one of our forms or tools:

  • Concierge requests. When you ask to be matched with an agent, we collect your name, email, phone number, your role (buyer, seller, both), the towns you're interested in, price range, timeline, priorities, and any notes you add.
  • Agent applications & partnership inquiries. If you are a real estate professional applying for a listing or a Featured/Premier placement, we collect your name, firm, contact details, DRE license number, website, track-record information, references, and the content of your application.
  • Ad builder submissions. If you build an agent advertisement, we collect the content and images you enter or upload, including headshots, brokerage logos, listing and property photos, biographies, statistics, and reviews.
  • Contact & correspondence. If you email us or contact us, we keep your message and contact details so we can respond.

Please do not submit sensitive personal information (such as government identifiers beyond a professional license number, financial account numbers, or health information) through our forms, we do not need it and do not ask for it.

03Information collected automatically

When you visit the Site, certain information may be collected automatically by our hosting and infrastructure providers, including your IP address, browser type and settings, device information, referring pages, the pages you view, and the dates and times of your visits. This information helps us operate, secure, and improve the Site.

04Cookies & analytics

The Site uses cookies and similar technologies for essential functionality (such as remembering form drafts you save in your browser) and for analytics that help us understand how the Site is used.

We use PostHog, a product-analytics service, to measure how visitors find and use the Site so we can improve it. PostHog collects usage information such as the pages you view, links and buttons you interact with, your approximate location (derived from your IP address), and device and browser characteristics. This data is processed by PostHog, Inc. on our behalf as a service provider, and is governed by PostHog's privacy practices, available at posthog.com/privacy.

We use PostHog for our own analytics only. We do not use it to sell your personal information or to share it for cross-context behavioral advertising.

To finalize before launch

If PostHog is configured to set cookies (its default), the Site should present a cookie/consent notice and honor opt-out choices. cookie-consent banner + PostHog opt-out, to wire before launch. If PostHog is run in cookieless / persistence-disabled mode, note that here instead.

Most browsers let you refuse or delete cookies through their settings, and you can opt out of analytics tracking using our cookie-consent controls where provided. Some features of the Site may not function properly without essential cookies. We honor the Global Privacy Control (GPC) signal where required by law as a valid request to opt out of the sale or sharing of personal information.

05How we use information

We use the information described above to:

  • Connect you with real estate agents and respond to your Concierge requests and inquiries.
  • Review and process agent applications, partnership requests, and advertisements.
  • Operate, maintain, secure, and improve the Site and its features.
  • Communicate with you about your requests, your account or ad, and important changes.
  • Detect, prevent, and address fraud, abuse, security issues, and technical problems.
  • Comply with legal obligations and enforce our Terms of Service.

We will only send you marketing communications where permitted by law, and you can opt out at any time using the unsubscribe link or by contacting us.

06How we share information

We share personal information only as described here:

  • With agents you ask to reach. When you submit a Concierge request or contact an agent, we share the details needed to fulfill that request with the relevant agent(s) so they can respond to you.
  • With service providers. We use vendors that perform services on our behalf, such as hosting, email delivery, form processing, image storage, and analytics, and share information with them only as needed to provide those services.
  • For legal reasons. We may disclose information if required by law, subpoena, or legal process, or to protect the rights, property, or safety of our users, the public, or us.
  • Business transfers. If we are involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction, subject to this policy.

We do not sell your personal information for money, and we do not share it for cross-context behavioral advertising as those terms are defined under California law.

07Your choices

  • Access & deletion. You can ask us to access, correct, or delete the personal information we hold about you (see Contact, below).
  • Marketing. You can opt out of marketing emails at any time via the unsubscribe link or by contacting us.
  • Cookies. You can manage cookies through your browser settings.
  • Form drafts. The ad builders store your draft in your own browser. You can clear it using the in-tool reset, or by clearing your browser storage.

08Your California privacy rights

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA/CPRA"), gives you the following rights regarding your personal information:

Right to know
Request the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the categories of third parties with whom we share it.
Right to delete
Request that we delete personal information we collected from you, subject to certain exceptions.
Right to correct
Request that we correct inaccurate personal information we hold about you.
Right to opt out
Opt out of any "sale" or "sharing" of personal information. As noted above, we do not sell or share personal information.
Right to limit
Limit the use of sensitive personal information. We do not use sensitive personal information for purposes that require an offer of this right.
Non-discrimination
We will not discriminate against you for exercising any of these rights.

To exercise any of these rights, contact us using the details in the Contact section. We will verify your request by confirming details we already hold (such as the email address you used). You may use an authorized agent to submit a request on your behalf, subject to verification. We will respond within the timeframes required by law.

California's "Shine the Light" law also lets California residents request information about disclosures of personal information to third parties for their direct marketing purposes. We do not disclose personal information for third parties' direct marketing.

09Data retention

We keep personal information only as long as necessary for the purposes described in this policy, for example, to fulfill your request, maintain an agent's listing or advertisement, comply with our legal obligations, resolve disputes, and enforce our agreements. When information is no longer needed, we take reasonable steps to delete or de-identify it.

10Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping any login credentials confidential.

11Children's privacy

The Site is intended for adults and is not directed to children under 16. We do not knowingly collect personal information from children under 16. If you believe a child has provided us personal information, please contact us and we will delete it.

12Third-party links

The Site contains links to third-party websites and services, including agents' websites and brokerages. We are not responsible for the privacy practices or content of those third parties. This policy applies only to the Site.

13Changes to this policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Site after an update means you accept the revised policy.
