01Acceptance of terms
These Terms of Service ("Terms") are a binding agreement between you and Agent Mojo, LLC ("we," "us," or "our"), which operates the Southern Marin Agents website (the "Site"). By accessing or using the Site, submitting a form, or creating an advertisement, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
02What the Site is
Southern Marin Agents is a curated advertising directory and information resource. It helps members of the public discover and contact independent real estate agents serving Marin County, California, and it publishes neighborhood, market, and lifestyle content. The Site facilitates introductions; it does not participate in any real estate transaction.
03Not a brokerage; no endorsement
Agent Mojo, LLC is not a licensed real estate broker or agent, is not a party to any transaction, and does not provide real estate, legal, financial, or other professional advice. The agents listed are independent third parties and are not our employees or agents.
A listing or feature is advertising, it is not an endorsement, recommendation, or guarantee of any agent's services, qualifications, or results. See our Licensing Disclaimer and Advertising Disclosure for details.
You are solely responsible for evaluating, selecting, and dealing with any agent or third party you find through the Site, including verifying their license and qualifications.
04Advertising & paid placement
The Site offers free and paid placement options to agents. Paid tiers (such as "Featured" and "Premier") affect the prominence, ordering, and presentation of an agent's listing. Our Advertising Disclosure explains how the directory is monetized and how paid placement influences what you see. By using the Site, you acknowledge that some placements are paid advertising.
05Eligibility & your account
You must be at least 18 years old and able to form a binding contract to use the Site. If you create an account or submit an application, you agree to provide accurate, current, and complete information and to keep it updated. You are responsible for activity that occurs under your account and for keeping your credentials confidential.
06Terms for agent advertisers
If you are a real estate professional who applies for or purchases a listing or advertisement, the following also apply:
- Accuracy & licensing. You represent that you hold a valid, active real estate license in good standing, that all information and claims you submit are truthful and not misleading, and that you will keep them current.
- Compliance. You agree to comply with all applicable laws and professional rules, including fair housing laws, advertising and disclosure rules, and the regulations of the California Department of Real Estate and your brokerage.
- Fees & term. Paid placements are subject to the fees, billing cycle, and term presented to you at sign-up. Unless stated otherwise, fees are non-refundable once a placement period begins. refund & cancellation terms, to be confirmed by Agent Mojo, LLC
- No guarantee of results. We do not guarantee any number of inquiries, leads, clients, transactions, or any specific result from a listing or advertisement.
- Our editorial discretion. We may review, edit for formatting, decline, suspend, or remove any listing, advertisement, or content at our discretion, including content we believe is inaccurate, unlawful, or inconsistent with the Site.
07Your content
"Your content" means anything you submit to the Site, including text, photographs, logos, biographies, statistics, reviews, and listings. You retain ownership of your content. By submitting it, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, adapt for formatting, publish, and display it on and in connection with the Site and its promotion, for as long as you maintain a presence on the Site and for a reasonable period afterward.
You represent that you own or have the rights to all content you submit, that it does not infringe anyone's rights or violate any law, and that any individual shown in a photograph has consented to its use. You are responsible for your content.
08Acceptable use
You agree not to:
- Use the Site for any unlawful, fraudulent, or misleading purpose, or in violation of fair housing or anti-discrimination laws.
- Post false, deceptive, defamatory, infringing, or harmful content.
- Scrape, harvest, or collect information about other users or agents, or use the Site's contact features to send spam or unsolicited commercial messages.
- Interfere with, disrupt, or attempt to gain unauthorized access to the Site or its systems.
- Misrepresent your identity, license status, or affiliation.
09Our intellectual property
The Site, including its design, text, graphics, logos, and the "Southern Marin Agents" name and marks, is owned by Agent Mojo, LLC or its licensors and is protected by intellectual property laws. Except for your own content, you may not copy, reproduce, distribute, or create derivative works from the Site without our prior written permission.
10Third-party content & links
The Site displays content provided by agents and other third parties and links to external websites. We do not control and are not responsible for third-party content, products, services, or websites, including market statistics, neighborhood data, and listings, which are provided for general information and may not be accurate, complete, or current.
11Disclaimers
THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any information (including agent details, market figures, or neighborhood data) is accurate, complete, or current. Any reliance you place on the Site is at your own risk.
12Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, AGENT MOJO, LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR YOUR DEALINGS WITH ANY AGENT OR THIRD PARTY, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
13Indemnification
You agree to indemnify, defend, and hold harmless Agent Mojo, LLC and its officers, members, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your content, your use of the Site, your dealings with any third party, or your violation of these Terms or any law or rights of another.
14Governing law & disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Subject to the paragraph below, you agree that any dispute arising out of or relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Marin County, California, and you consent to their jurisdiction.
Many directory operators include a binding arbitration clause and a class-action waiver. We have left this out pending your attorney's guidance, because arbitration and class-waiver clauses have specific consumer-notice and enforceability requirements in California. arbitration / class-waiver clause, decide with counsel
15Termination
We may suspend or terminate your access to the Site or remove any content at any time, with or without notice, including if we believe you have violated these Terms. You may stop using the Site at any time. Sections that by their nature should survive termination, including content licenses already granted, disclaimers, limitations of liability, and indemnification, will survive.
16General terms
- Changes. We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date, and your continued use means you accept the revised Terms.
- Entire agreement. These Terms, together with the Privacy Policy and any terms presented at sign-up, are the entire agreement between you and us regarding the Site.
- Severability. If any provision is held unenforceable, the remaining provisions stay in effect.
- No waiver. Our failure to enforce any provision is not a waiver of it.
- Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
